Terms of Service
Last updated: October 29, 2026
Summary. These Terms explain how you can use Hype Proxies’ proxies and cloud servers, how billing and renewals work, what you’re not allowed to do, and what happens if something goes wrong. Subscriptions renew automatically until you cancel. Some activities are banned outright, including fraud, attacks, adult content and accessing government systems. If we can’t resolve a dispute informally, it goes to individual arbitration, not court (section 14), unless you opt out within 30 days.
ARBITRATION NOTICE AND CLASS ACTION WAIVER. EXCEPT FOR THE DISPUTES DESCRIBED IN SECTION 14, YOU AND HYPE PROXIES AGREE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVE ANY RIGHT TO A JURY TRIAL OR TO TAKE PART IN A CLASS ACTION. YOU CAN OPT OUT AS DESCRIBED IN SECTION 14.
Introduction
Who we are. Hype Proxies is operated by HypeStatus Inc DBA HypeProxies (“Hype Proxies”, “we”, “us”, “our”).
What these Terms cover. These Terms of Service (“Terms”) apply to:
hypeproxies.com and the client area at dash.hypeproxies.com (the “Websites”);
everything we provide through them: proxies (including ISP and static residential proxies), cloud and dedicated servers (including VPS, AMD EPYC, bare metal and sneaker servers), and related support (the “Services”).
What documents make up the Terms. These Terms include the following policies, which are part of your agreement with us:
the Refund Policy;
the Privacy Policy;
the SMS Terms, if you sign up for text messages;
any order form or plan details shown at checkout.
If a separate written agreement signed by both of us (for example an enterprise agreement) conflicts with these Terms, that agreement wins for the Services it covers.
Who they apply to. These Terms apply to anyone who visits the Websites, creates an account, starts a trial, places an order or uses the Services. If you accept these Terms for a company or other organization, you confirm you’re authorized to bind it, and “you” means that organization.
When they apply. You accept these Terms when you create an account, place an order, start a trial, or use the Services, whichever happens first. If you don’t agree, don’t use the Websites or the Services.
1. Eligibility and registration
1.1 You must be at least 18 years old and able to form a binding contract. The Services are for business and professional use.
1.2 You must not:
be on a government sanctions or restricted-parties list;
be located in, or be ordinarily resident in, a country or region subject to comprehensive US sanctions;
use the Services on behalf of anyone who is.
1.3 Give accurate, complete registration and billing information, and keep it current.
1.4 You’re responsible for keeping your passwords, API keys, proxy credentials and server access secure, and for everything that happens through your account, including by people you give access to. Tell us straight away at support@hypeproxies.io if you think your account has been compromised.
1.5 We may verify your identity, business or intended use at any time, before or after delivering the Services. We may decline, cancel or suspend an order or account if verification fails or isn’t completed.
1.6 One person or organization may not open multiple accounts to get around a limit, a suspension, a trial or a promotion.
2. The Services
2.1 Proxies. A proxy plan gives you the right to route traffic through the IP addresses allocated to you for the plan’s term. Each ISP proxy IP is dedicated to one customer on every plan. IP addresses remain the property of Hype Proxies or our upstream providers, and you get no ownership or other rights in them. We may replace an IP address when needed (for example after abuse reports, an upstream change or a technical problem), and we’ll try to provide a working replacement.
2.2 Cloud and dedicated servers. A server plan gives you a virtual or dedicated server with the resources listed on your order. You have administrative control of the server, and you’re responsible for:
the operating system, software, configuration, security patches, firewalls and passwords on it;
everything stored on or sent from it.
2.3 Bandwidth and fair use. Where a plan says “unlimited” bandwidth or threads, normal use is unlimited, subject to the Acceptable Use Policy. We may limit, throttle or ask you to change usage that:
degrades our network or other customers’ service;
puts our upstream providers or IP reputation at risk.
2.4 No guaranteed results or uptime. We work to keep the Services fast and available, but unless a separate written service-level agreement says otherwise, we don’t guarantee uptime, speed, or that any website or platform will accept a given IP address. Websites can block, rate-limit or change their rules at any time, outside our control.
2.5 Changes to the Services. We may add, change or retire features, locations or plans. If we retire a Service you’ve prepaid for, we’ll offer a reasonable alternative or a pro-rated credit for the unused time.
2.6 Beta and trial features. Features marked beta, preview or early access are provided as is, may change or stop at any time, and aren’t covered by any service commitment. Our liability for them is limited to the amount you paid for them in the month before a claim (if any).
3. Rules of conduct
3.1 You may use the Services only for lawful, legitimate purposes and in line with the Acceptable Use Policy.
3.2 Prohibited activities. You may not use the Services, or let anyone else use them, to:
Break the law: any activity that’s illegal where you are, where we are, or where your traffic goes, or that helps someone else break the law.
Commit fraud or other “black hat” activity, including:
carding or payment fraud;
account takeover, credential stuffing or password brute-forcing;
phishing, impersonation or identity theft;
ad fraud or click fraud;
fake reviews, fake engagement or fake accounts made to deceive;
scams of any kind.
Attack or break into systems, including:
DDoS or traffic flooding;
port or vulnerability scanning, or exploiting systems, without the owner’s written permission;
hosting or spreading malware, ransomware, botnets or command-and-control infrastructure;
getting around authentication or security controls without authorization.
Access government or military systems: any website, network or system of a government, military, or law-enforcement body in any country (including .gov and .mil domains).
Adult content: access, host, store or distribute pornographic or sexually explicit material. Content that sexually exploits minors is banned absolutely; we report it to the authorities and keep evidence as the law requires.
Access other websites unlawfully: you’re responsible for making sure your use of any website or platform you access through the Services is lawful and complies with any agreement you’ve entered into with it. Don’t use the Services to violate laws that protect those sites, such as laws against unauthorized computer access or fraud.
Spam or message abuse: send unsolicited bulk email, SMS or messages, or run open proxies, open mail relays or anonymizing services for the public.
Infringe rights: copyright, trademark, patent, privacy, publicity or other rights.
Harvest data unlawfully: collect personal data or non-public data without a lawful basis, or in breach of a site’s technical access restrictions or a contract you’re bound by.
Resell without approval: resell, sublease, share or redistribute the Services without our prior written approval.
Harm our network: disrupt our network or our upstream providers, or use the Services in a way that gets our IP addresses flagged, blacklisted or blocked.
Mine cryptocurrency on our servers, or run proof-of-work or proof-of-space workloads on them.
3.3 Your responsibility. You’re responsible for all traffic and activity through your proxies and servers, including traffic from your own customers, users, scripts and bots. Don’t let anyone use your access in a way you couldn’t.
3.4 Monitoring and abuse reports. We don’t routinely monitor the content of your traffic, but we may review usage data and investigate when we receive a complaint, detect abuse or are required to by law. When we get an abuse report about your Services, we may:
forward it to you and ask you to respond or stop the activity by a deadline;
act straight away under section 11 if the activity is serious or ongoing.
Report abuse to abuse@hypeproxies.com.
3.5 Copyright complaints. To report content on our servers that infringes your copyright, send a notice that meets the requirements of the US Digital Millennium Copyright Act to our designated agent: Legal Department, HypeStatus Inc DBA HypeProxies, 30 N Gould Street, Ste R, Sheridan, WY 82801; legal@hypeproxies.io. We may remove or disable access to infringing content and terminate repeat infringers.
3.6 Law enforcement. We may preserve and disclose information to law enforcement or other authorities when the law requires it, or when we reasonably believe it’s needed to prevent harm, as described in our Privacy Policy.
4. Payments and billing
4.1 Prices. Prices are in US dollars and are the prices shown in our store (dash.hypeproxies.com) when you order. Applicable taxes are added at checkout. We use third-party payment processors, including card and cryptocurrency processors, and their terms may also apply.
4.2 Automatic renewal. Subscriptions renew automatically at the end of each billing period (for example monthly or quarterly) at the then-current price until you cancel. You authorize us and our processors to:
charge your saved payment method for each renewal, or issue an invoice that’s due by its due date;
use updated card details from your card network where that’s supported.
4.3 Cancellation. You can cancel any time from the client area before your next renewal date. The Services stay active until the end of the period you’ve paid for. Apart from what the Refund Policy allows, fees already paid aren’t refundable and we don’t give partial or pro-rated refunds.
4.4 Late or failed payment. If an invoice is still unpaid 3 days after its due date, we may suspend the Services. If it’s still unpaid 5 days after its due date, we may terminate the Services, release or reassign the IP addresses, and delete servers and their data.
4.5 Price changes. We may change prices for future billing periods. We’ll tell you before a new price applies to a renewal, and a change never affects a period you’ve already paid for.
4.6 Disputed charges. If you think a charge is wrong, contact us within 30 days of it. If you file a chargeback for a valid charge instead, we may suspend your account until it’s resolved and recover our costs.
4.7 Promotions and discount codes. Unless their terms say otherwise, promotions and codes:
can be used once per customer and can’t be combined;
have no cash value;
can end at any time.
We may cancel orders that misuse a promotion.
4.8 Free trials. We may offer a free trial of our proxies (currently 48 hours, with no credit card needed). Trials are for evaluation only, limited to one per person or organization, and we may decline or end a trial at any time. Servers don’t have a free trial; they have the money-back guarantee in the Refund Policy.
4.9 Refunds. Refunds are governed by our Refund Policy:
Proxies: requests within 3 days of the initial purchase, for technical issues, misrepresentation or unauthorized purchases.
Servers: a 3-day money-back guarantee on the first payment, for technical issues that stop you using the server; renewals aren’t covered.
Suspensions: accounts suspended or terminated for breaking these Terms or the Acceptable Use Policy aren’t eligible for a refund.
5. Your content and data
5.1 Your content stays yours. Content and data you store on or send through the Services (“Customer Content”) remains yours. You give us only the limited rights we need to provide, secure and support the Services and to comply with the law.
5.2 Your responsibility. You’re responsible for:
your Customer Content;
having the rights and consents needed for it;
keeping your own backups. We don’t guarantee that we’ll keep, back up or be able to recover Customer Content.
5.3 After termination. When a server is cancelled or terminated, its disks and data are deleted and can’t be recovered. Download anything you need before your Services end.
5.4 Personal data. We handle personal data as described in our Privacy Policy.
6. Third-party services
The Services rely on third parties, including upstream network and IP providers, data centers and payment processors. You may also use third-party software with the Services. We aren’t responsible for third-party services or software, and your use of them may be subject to their own terms.
7. Our intellectual property
The Websites, client area, software, documentation and brand are owned by Hype Proxies or our licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use them only to use the Services under these Terms. If you send us feedback or suggestions, we may use them without any obligation to you.
8. Confidentiality
Non-public information either of us shares about our business, pricing or systems, and marks or reasonably understands as confidential, must be used only for this agreement and protected with reasonable care. This doesn’t cover information that’s public through no fault of the receiver, already known to it, or independently developed.
9. No warranty
THE WEBSITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, HYPE PROXIES DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY. THAT INCLUDES WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY WEBSITE OR PLATFORM WILL ACCEPT THEM.
10. Limitation of liability
10.1 TO THE FULLEST EXTENT ALLOWED BY LAW, HYPE PROXIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES. THAT INCLUDES LOST PROFITS, REVENUE, DATA, GOODWILL, OR MISSED PURCHASES, DROPS OR RELEASES, EVEN IF WE WERE ADVISED THEY WERE POSSIBLE.
10.2 TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITES OR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE THAT GAVE RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
10.3 Some jurisdictions don’t allow these exclusions or limits, so they may not fully apply to you.
11. Suspension and termination
11.1 Suspension. We may suspend all or part of the Services, with or without notice, if:
your use poses a security risk or threatens the integrity or availability of our network or other customers;
you breach these Terms or the Acceptable Use Policy;
we receive abuse complaints about your use;
a payment fails or is charged back;
the law or an authority requires it.
Where it’s reasonable and safe, we’ll tell you why and give you a chance to fix the problem first.
11.2 Termination by you. You can stop using the Services and cancel at any time from the client area (see section 4.3).
11.3 Termination by us. We may terminate your account or Services:
for a serious or repeated breach of these Terms or the Acceptable Use Policy;
for non-payment (section 4.4);
on 30 days’ notice for any other reason, in which case we’ll refund any prepaid, unused fees.
11.4 What happens at termination.
Your right to use the Services ends.
IP addresses are released or reassigned.
Servers and Customer Content are deleted (section 5.3).
Sections 4 (amounts owed), 5.3, 7 to 10, 12, 14 and 15 continue to apply after termination.
12. Indemnification
You’ll defend, indemnify and hold harmless Hype Proxies and its officers, employees, suppliers and upstream providers from any third-party claim, loss, liability, damage or cost (including reasonable legal fees) arising from:
your use of the Services or your Customer Content;
traffic sent through your proxies or servers;
your breach of these Terms or the Acceptable Use Policy;
your violation of any law or third-party right.
13. Changes to these Terms
We may update these Terms from time to time. We’ll post the new version on this page and update the “Last updated” date. For material changes, we’ll also notify you, for example by email to your account address or in the client area, at least 14 days before they take effect, except where a change is required by law or to address abuse or security. If you keep using the Services after a change takes effect, you accept the updated Terms. If you don’t agree, cancel before it takes effect.
14. Dispute resolution and arbitration
14.1 Talk to us first. Before starting any formal claim, email support@hypeproxies.io with a description of the dispute. We’ll try in good faith to resolve it within 60 days.
14.2 Arbitration. If we can’t resolve it, any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules. The arbitration will take place in Sheridan County, Wyoming, unless we both agree to hold it remotely. Either of us may still:
bring an individual claim in small-claims court;
ask a court for an injunction to protect intellectual property or stop abuse of the Services.
14.3 Class action waiver. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
14.4 Opt-out. You can opt out of arbitration by emailing support@hypeproxies.io, with the subject “Arbitration opt-out”, within 30 days of first accepting these Terms. If you opt out, section 14.5 applies to all disputes.
14.5 Courts. Disputes not subject to arbitration go only to the state courts located in Sheridan County, Wyoming, or the United States District Court for the District of Wyoming, and we each consent to their jurisdiction.
15. General
15.1 Governing law. These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules.
15.2 Export controls and sanctions. You’ll comply with all applicable export control and sanctions laws, including US regulations, and won’t use, export, re-export or transfer the Services in violation of them. Breaching this section may lead to immediate suspension or termination.
15.3 Notices. We may send notices to the email address on your account or post them in the client area. Send legal notices to legal@hypeproxies.io or by mail to HypeStatus Inc DBA HypeProxies, 30 N Gould Street, Ste R, Sheridan, WY 82801. Send everything else to support@hypeproxies.io.
15.4 Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign them in a merger, acquisition or sale of assets.
15.5 Force majeure. Neither of us is responsible for delays or failures caused by events beyond reasonable control, including:
upstream provider, carrier or power outages;
attacks on our network;
natural disasters;
acts of government.
This doesn’t excuse payment obligations.
15.6 Entire agreement; severability; no waiver. These Terms, with the policies listed in the Introduction, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Not enforcing a right isn’t a waiver of it.
15.7 Independent parties. We’re independent contractors. Nothing in these Terms creates a partnership, joint venture or agency.
